Bollywood actor Sanjay Dutt will surrender himself on May 15 after the Supreme Court rejected his review petition in the 1993 Bombay blasts case on Friday. The apex court maintained that his appeal has no merit and the decision to uphold his conviction will be sustained.
A bench of P Sathasivam and BS Chauhan also rejected similar review petitions of Yusuf Mohsin Nulwalla, Khalil Ahmed Sayed Ali Nazir, Mohamed Dawood Yusuf Khan, Shaikh Asif Yusuf, Muzammil Umar Kadri and Mohd Ahmed Shaikh.
“Sanjay Dutt knew that the review plea will be rejected. He will exercise the next legal option available to him,” filmmaker Mahesh Bhatt said.
According to legal experts, Dutt can apply for mercy only after he has surrendered himself. Another option would be to file a curative petition; however, that option is only viable if the oversight of evidence is proven.
“A curative petition is the only option but there are no grounds for this petition… He has to surrender,” Shivaji Jadhav, a lawyer representing Dutt said.
Last month, the apex court agreed to extend Dutt’s surrender time to another four weeks before he serves the remaining 42 months in jail to finish his sentence. Supreme Court has already reduced to five years the six-year jail-term awarded to him by a designated TADA court in 2006.
