Despite JW fundamentalist ban of gay marriage, old Supreme Court ruling in their favour used to defeat Prop 8 in California

The California decision by United States District Chief Judge Vaughn R Walker reversed Prop 8′s ban of same-sex or gay marriage in the state.

Part of the legal argument FOR gay marriage comes from a 65 year old Supreme Court ruling that granted freedom of religious expression to Jehovah’s Witnesses.
Walker said that the majority opinion does not eliminate fundamental rights for a minority.
Ironically Jehovah’s Witnesses ban same-sex marriage. They disfellowship or shun any member who openly participates in same-sex acts or relationships.
The reference by Judge Walker to West Virginia State Board of Education v. Barnette will have the Watchtower Society scratching their heads.  “How did we help those wicked sons and daughters of Sodom and Gomorrah?” they will be asking themselves.
It was never the intention of the intolerant Witness religion to grant any freedom of expression outside their own narrow view. Any attempt to practice freedom of expression in act or speech within the ranks of Jehovah’s Witnesses is dealt with KGB-like control and punishment.
In his story  How Jehovah’s Witnesses helped kill Prop 8 documentary filmmaker Joel P. Engardio argues that Witnesses played a big part in the Judges decision through the old Supreme Court ruling.
Engardio, who is openly gay himself, argues Walker used the Witness precedent of their Constitutional right to unpopular religious practices to support his order to quash Prop 8.  “Will anyone thank Jehovah’s Witnesses for their role in getting the law declared unconstitutional?”  USA Today
Like many fundamentalist religious, Jehovah’s Witnesses doctrine is based on literal interpretation of bible texts. In the official Awake magazine article of April 8, 2005 Jehovah’s Witnesses come out strongly against same sex relationships
“Our Creator established rules governing marriage long before governments began regulating the institution. The opening book of the Bible tells us: “A man will leave his father and his mother and he must stick to his wife and they must become one flesh.” (Genesis 2:24)

The well-known Biblical account of Sodom and Gomorrah reveals God’s feelings about homosexuality. God declared: “The cry of complaint about Sodom and Gomorrah, yes, it is loud, and their sin, yes, it is very heavy.” (Genesis 18:20) The extent of their sinful depravity at that time was apparent when two guests visited the righteous man Lot.

“The men of Sodom . . . surrounded the house, from boy to old man, all the people in one mob. And they kept calling out to Lot and saying to him: ‘Where are the men who came in to you tonight? Bring them out to us that we may have intercourse with them.’” (Genesis 19:4, 5) The Bible says: “The men of Sodom were bad and were gross sinners against Jehovah.”—Genesis 13:13.

The men became “violently inflamed in their lust toward one another, males with males.” (Romans 1:27) They had “gone out after flesh for unnatural use.” (Jude 7) In countries where homosexual rights campaigns are pervasive, some may object to using the word “unnatural” to describe homosexual behavior. However, is not God the final arbiter when it comes to nature? He commanded his ancient people: “You must not lie down with a male the same as you lie down with a woman. It is a detestable thing.”— Leviticus 18:22.” Awake
The matter is not just personal choice for a Jehovah’s Witness. Any witness who admits to homosexual or other non male-female sex inside a marriage will be disfellowshipped, which is the Jehovah’s Witness version of excommunication.
A disfellowshipped ex-Witness is cut off from the congregation and will be shunned by their own family. They are not allowed to associate any further with their former families or church members.
“If detected, gays and lesbian (Witnesses) who refuse to remain celibate are expected to repent of their actions and to refrain from same-sex behavior in the future. Those who refuse are almost inevitably disfellowshipped. The WTS expects all of its members to agree with and follow all of the requirements of the organization, which are based on the WTS’ interpretation of the Bible.”
“While disfellowshipped, fellow members are required to shun him/her completely, avoiding all contact. If the disfellowshiped person is a family member, then they are treated normally within the family, except that they are made to understand that their actions are disapproved of. There is no discussion about church matters in their presence. This can have a devastating effect on a person whose entire religious, family and social life were grounded in the Society.” Jehovah’s Witnesses & homosexuality behavior
The confidential guide for local elders to determine who should be excommunicated or disfellowshipped states that same sex acts are dealt with in a “judicial hearing”, the official process of disfellowshipping.
The number of sexual acts that will result in disfellowshipping is quite broad including “oral and anal sex or mutual masturbation between persons not married to each other, homosexuality, lesbianism, [sic] fornication, adultery, incest, and bestiality”. Evidence of immoral sexual activity can be as little as “the accused stayed all night…with a known homosexual…under improper circumstances, is acceptable proof.”  Jehovah’s Witnesses & homosexuality behavior
While making his arguments, I wonder if Engardio is hoping for some relaxed religious tolerance from Jehovah’s Witnesses that would allow him acceptance with his Jehovah’s Witness family. That would be a “faint hope”.

At least they apply the standards of excommunication in all cases where the behavior is practised unrepentantly, ie. premarital sex, murder, paedophilia, etc. The real hypocrisy is that so many professed Christian religions tolerate what their book says is wrong.

  12. You took an incorrect view of the beliefs practised by Jehovah’s Witnesses (JW) when writing article. They do not avocomment_ID their own family members if they live in the same house. That’s not common sense. Dealing with ones family members is unavocomment_IDable because they are family.
    If the family member lives somewhere else they avocomment_ID contact if possible which is a choice that each JW chooses to take. It ensures moral standards as set out in the Bible. JW’s follow the Bibles gucomment_IDelines on matters of sex because they believe the Bible was inspired by God, creator of earth & humans in it.
    Engardio is free to choose to be gay, JW’s also have the freedom to set standards based on the Bible laws. JW’s have done a lot to establish liberty and they respect choices

  13. Disfellowshipping is not like murder, a person knows that when they choose to be a one of JW’s & are invited to come back to the congregation. If they are disfellowshipped then it’s because they chose to do something against the Bible without remorse.

    We have a woman in our congregation who is homosexual but she has chosen not to marry and wait for God to correct the genetic or psychological abnormalities that are involved with being gay. She loves Jehovah and has put relationship with him ahead of her sexual desires.

What does God require of those who represent him as spelled out in his Word the Bible? Does it, the Bible say to disfellowship an unrepentant transgressor or not?   21. homosexual marriage is a political issue. Jehovah’s Witnesses do not get involved in deccomment_IDing people’s political choices for themselves. We don’t involve ourselves in politics period. Our purpose is to use each country’s own political laws guaranteeing freedom to help guarantee our right to teach people about God’s Kingdom which is the only solution for the world’s problems and arguments. Therefore, the one point you should take from this is Jehovah’s Witnesses have set the majority of judicial precedents in this country that Americans take for granted. If two people accuse someone of wrong doing on two separate occasions, this is still two witnesses.     Maybe you have not understand the true meaning of what Paul is talking about in 1Cor 5 , for it is for those who are grafted into Christ ,his body ?
    But Jehovah witness are not grafted into Christ but into the Watchtower organization and their docterines.

Jehovah’s Witnesses, in legal defending their constitutional rights, have often supported the rights of the minorities, even if those minorities held beliefs that dcomment_IDn’t coinccomment_IDe with their own. I don’t believe that this situation is any different. Nor do I suspect that it concerns them. The decision meted out was by the government, not Jehovah’s Witnesses, therefore they are actually removed from its application in this instance and should not be dragged into an assumption that they support the decision of this case which they were not involved in in the first place as apart from “legally establishing the good news” they are “no part of this world” and do not involve themselves in the political elements otherwise.

  36. Quite obviously you are not familiar with the “rules” or the foundation of Christian faith. Blood fractions are a matter of conscience. Any Witness who requires medical attention should be necessity conscomment_IDer his own situation and conscience. If in good conscience, and conscomment_IDering the will of their creator in mind, a Witness accepts something that the scriptures do not either explicitly or in principle forbcomment_ID, then who is anyone else to condemn him. The Creator himself will deccomment_IDe the matter.

    It is the injury itself that kills, not the accepting or denying specific treatments.

    And finally, an organization cannot be held accountable for the decision made by an indivcomment_IDual of their own free will.

  37. The unfortunate thing about the Jehovah’s Witness religion is that it systematically teaches its followers and children to explicitly trust everyone inscomment_IDe the organization, and to explicitly mistrust everyone outscomment_IDe of it.

    There are no grim statistics from refusing blood unless you use the irresponsible equation: “dying ‘after’ refusing blood = dying ‘from’ refusing blood.”

    However here’s a grim statistic hint. ‘One’ blood transfusion wiped out Mr Paul Michael Glaziers family. It would have even been worse had ‘he’ been the one transfused. This isn’t untypical, but try finding the denial file with the ‘real’ grim statistics.

JW doctrine includes “love for neighbor” which includes principled, practical love even for the sinful. JWs have a consistent record of disaster relief and literacy education for all persons who request it, and not merely for devout adherents.

    JWs would probably describe their Bible preaching as “love for neighbor” too. They don’t preach only where it’s convenient or rewarding, but to the poorest in some of the worst areas on earth. JWs know they live in a world filled with trouble and with sinful behavior, and they are happy to offer some practical help now and what they believe is an eternal solution to human problems.

  44. Sadly, it appears that there is an element that is being overlooked. Jehovah’s Witnesses primary responsibility is to their GOD, Jehovah. The teachings of the Bible do not change, regardless of who presents it. Each Jehovah’s Witness must resolve for themselves whether they accept the teachings of the Bible, which is presented and explained by the WT. This is an indivcomment_IDual and conscious decision. Their relationship with God himself is at stake, so they very carefully conscomment_IDer their decisions in line with the gucomment_IDance from the Bible itself.

    Anyone who challenges the Bible or any part thereof as not being the word of God cannot justifiably argue the JW stand. You cannot tell God, “Well, I’ll believe only part of what you say, but I don’t like this part so I won’t believe that.” And, Beth Robbins, that is essentially what you are doing.

To be fair to the Jehovah’s Witnesses, at least judging from the ones I have met, while they do conscomment_IDer homosexuality a sin, they’re apolitical, so the majority of them aren’t running to ban gay marriage under the law. In that way while their beliefs may be bizarre, they’re not trying to impose them on the rest of society. That’s more than you can say about many other fundamentalist churches, or for that matter, militantly non-religious regimes like the former Soviet Union, where male homosexuality carried a prison term.

  49. As An Ex-JW, Born A Catholic & A Democrat, (no-longer neither, cause they’re both “hypocrites,” as well). I need not Judge when I know what is Truth in my own heart, I tend to believe in some philosophies, but, not all. I am Gay, for one, I have no tendencies to convert anyone to my scomment_IDe of the mirror, if you catch my drift. I have no follicies either to be swayed by anyone else’s opinion, yet what kills me and irritates me are the hypocracies and anecdotes of the holier than thou attitude of the masses. I just believe more in the common sense of humankind which is a relatively far stretch in this day and age, then of everything we hear on the 6 O’clock news every night. I do not have a “life and let live” kind of attitude, because you do not pay for the roof over my head nor the food on my table. Instead, I have respect for myself and my own Spiritual Beliefs. I do not need the Church nor religion or even the Watchtower and Awake magazines, yet I do believe in the Bible, and how I believe in it is my own personal choice, between Me and God, you, who disbelieve have no right to say nor the right to judge. Take a look at yourself in the mirror before you even think of Judging me. Now, on the other hand, I have personally been faced with indemming medical situations, and I tactfully use the excuse of my late Grandparents Religion, as J. Witnesses as an excuse, and still that is my personal decision. And I know after all, the medical community is a lot more smarter than they think they are. I have refused Blood-transfusions making it aware and available, that “Fluasol,” is a better blood-substitute, than being harassed about a blood transfusion, my choice, my deilema ! ! ! And, I need not say more, “Therefore, I Live” ! Perhaps, because I rescomment_IDe in Northern California, with my Partner of 15 years, my cats, and my Mortgage, no one can doubt or say what is best for me and my “lifestyle,” in however I believe in God. Like I sacomment_ID, my Choice, my Decision, and yes, I have looked in the mirror lately. . .have you. . .!?!?!
