Juba Jan.9th 2015, South Sudan's Bar Association was conducting its leadership elections today in Juba unfortunately the National Security Service interrupted their elections process with the reason that the Association have not obtained official permission for the conduct of their association elections and same incident happened in Wau town of Western Bahr El Ghazal state. In Juba incident a journalist from Gurtong Website named Jok Akur Ngaar was arrested too for covering the event
CEPO condemned the incidents and viewed this development as disturbing and demonstrating challenge to the freedom of association and assembly stipulated in South Sudan Transitional Constitution articles 25(1)“ The right to peaceful assembly is recognized and guaranteed; every person shall have the right to freedom of association with others, including the right to form or join political parties, associations and trade or professional unions for the protection of his or her interests” together with article 24 “Freedom of Expression and Media” of same constitution. Violation of approved rights and freedoms by the national constitution is undemocratic practice
Mr. Edmund Yakani, Executive Director of CEPO said the country is seriously requires existence of professional association such as Bar Association for several reasons. Among the key reasons are provisions of legal aid services for the public who can affordable defense lawyer from the market for protecting their right of equal protection by law, regulation of lawyers in the market on professional ethics and judicial activism.
Politicizing formation of such as entity which is 100% professional is great mistake and it will harm the national, Mr. Yakani stressed
Finally CEPO is urging the leadership of the National Security Services kindly to allow the elections of the South Sudan Bar Association to go ahead freely and fairly. Additionally, free the Gurtong Journalist. This is vital process for the growth of our Nation South Sudan.
